1. Introduction

Try It On is a product of NFN Labs (OPC) Pvt Ltd ("NFN Labs," "we," "us" or "our"). This policy explains what data we collect, why, how long we keep it and the rights you have. It covers two services:

• Try It On Chrome extension (the "Extension"): a browser extension that lets you see clothing from online stores on yourself.
• Try It On for Shopify (the "Shopify App"): an app that Shopify merchants add to their online store, so their shoppers can try products on from a photo.

How to read this policy: Part A (Section 3) applies only to the Extension. Part B (Section 4) applies only to the Shopify App. Sections 1, 2 and 5 to 12 apply to both.

We process personal data in line with the Digital Personal Data Protection Act, 2023 (India), the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), where they apply.

2. Our role

Who decides how your data is used depends on which service you use.

For shoppers, the merchant whose store you are in is responsible for offering try-on to you and for telling you about it in their own privacy policy. We process your photo only on that merchant's behalf and only to produce your try-on.

3. Part A: Try It On Chrome extension

This part applies when you install and use the Extension yourself.

3.1 Information we collect and our legal basis

About reference photos: your photos show your physical appearance, which some laws treat as sensitive or biometric-adjacent data. You give consent separately from accepting our Terms, when you upload. You can withdraw it at any time by deleting your photos or your account (Section 3.3).

3.2 How we use it

• To generate try-on images from your reference photos and the products you choose.
• To keep your feed, so you can view, favourite and compare past try-ons.
• To screen uploaded photos automatically for explicit, illegal or prohibited content.
• To process payments, send service and security messages, and answer support requests.
• To improve the Service using aggregated, de-identified usage trends.
• To meet legal obligations, resolve disputes and enforce our Terms.

3.3 Retention and deletion

• Reference photos and try-on history are kept while your account is active, so your feed stays available.
• Deleting photos or your account: you can do this at any time inside the Extension, or by emailing contact@nfnlabs.in. We act on email requests within 30 days.
• After account deletion, your data is removed from our active systems within 30 days and from backups within 90 days, unless the law requires us to keep it longer.

3.4 Services the Extension relies on

• Google Sign-In: your sign-in is also subject to Google's Privacy Policy.
• Online stores: the Extension runs on third-party sites such as Amazon, Myntra and Ajio. Their own privacy policies apply to your use of those sites. We do not scrape or store their catalogues; we fetch only the product image you choose to try on.
• Payments: handled by [Stripe]. We never store your full card details.

3.5 Cookies and analytics

• Essential storage: cookies and browser local storage keep you signed in and remember your settings.
• Analytics: we use Google Analytics with IP anonymisation to see aggregated usage. We do not send your name, email or photos to analytics providers. You can opt out with the Google Analytics opt-out add-on.
• Your choices: you can block cookies in your browser settings, though some features may then stop working.

4. Part B: Try It On for Shopify

This part applies to merchants who install the Shopify App, and to shoppers who use try-on on a merchant's store.

4.1 Information we collect from merchants

• Store information from Shopify: store name, store domain, store owner's name and email address, country, currency and Shopify plan. We use it to set up and run your account.
• Product information from Shopify: titles, types, tags, categories and images of products, used to prepare try-ons. We access it through the permissions you approve at install: [read_products, …].
• Billing information: your plan, subscription status, subscription and top-up credit balances, extra try-on pack purchases and try-on usage. Shopify processes all payments through Shopify Billing, and we never receive card or bank details.
• Settings and usage: your app settings, which products show try-on, and technical logs.
• Support messages: what you send when you contact us.

The Shopify App does not access your orders, customer lists, customer addresses or payment information.

4.2 Information we collect from shoppers

• Name: personalization of the Try-On experience (optional)
• Uploaded photo: the photo of yourself you choose to upload. It shows your appearance and may be treated as sensitive or biometric-adjacent data.
• Generated image: the try-on image made from your photo and the product image.
• Session and technical data: the product tried on, a random session identifier, browser type, device type and IP address. We use this to deliver the try-on, prevent abuse and count usage against the merchant's plan.

You do not need an account with us. We do not collect your name, email address or payment details through the Shopify App. You are required to sign in to your customer account on the merchant's store to access the Try-On feature; we receive your Shopify customer ID from that store, so your try-ons are linked to your account there. We use it only to show your past try-ons, and never to identify you outside that store.

Consent: before you upload a photo, the try-on window explains how it is used, and you must confirm to continue. You must be 18 or older, and may upload only photos of yourself.

4.3 How we use it

• To generate try-on images, including selecting and analysing the merchant's product photos.
• To screen uploaded photos automatically for explicit, illegal or prohibited content, and check they are suitable for try-on (for example, pose).
• To count try-ons against the merchant's plan and bill through Shopify.
• To provide support, keep the app secure and prevent fraud or abuse.
• To improve the app using aggregated, de-identified usage statistics.

We do not use shopper data for our own marketing, and we never combine it with Extension data.

4.4 Retention and deletion

4.5 Shopify privacy requests

We respond to Shopify's mandatory privacy requests:

• Customer data request: we give the merchant any data we hold about that customer.
• Customer deletion request: we delete that data.
• Shop deletion request: we delete the store's data.

A shopper is required to sign in to access the Try-On feature and their photo and try-ons are linked to their Shopify customer ID. For a customer data request, we give the merchant the photo and try-on images we hold for that ID. For a deletion request, we permanently delete them.

4.6 Merchant responsibilities

By enabling the Shopify App, merchants agree to tell shoppers in their store's privacy policy that they use Try It On for virtual try-on, with a link to this policy, and to use the app only in line with applicable law. Suggested wording:

We use Try It On, a virtual try-on service by NFN Labs. If you use the try-on button, the photo you upload is sent to NFN Labs to create an image of you wearing the product, and is kept only until you replace it or ask for it to be deleted. It is not used to train AI models or for advertising. See the Try It On Privacy Policy.

5. AI and data commitments

These apply to every photo and image in both services.

• No training: we never use your photos or generated images to train our own or any third party's AI models.
• No sale: we do not sell personal data, or share it for cross-context behavioural advertising.
• No identification: we do not use photos to identify people, or create face or body templates or other biometric identifiers.
• Our AI provider: try-on images are generated with Google's Gemini API, used under Google's paid-service terms, which bar Google from using this data to train its models.
• Content screening: uploaded photos are screened automatically for explicit or illegal content. Flagged content may be reviewed as described in our Terms, and is never used for training.
• Output ownership: you keep ownership of your photos, and retailers keep ownership of their product images. Our Terms of Use set out how generated images may be used.

6. Sharing and subprocessors

We share data only with providers that help us run the services. Each is bound by a data processing agreement to use it only on our instructions.

We may also disclose data when the law requires it, to protect people's safety or our rights, or to a successor in a merger or acquisition under the same protections.

7. Data security

• TLS encryption for all data in transit, and AES-256 encryption at rest.
• Role-based access controls, and images served only through time-limited signed URLs.
• Regular security assessments, and collecting only the data each service needs.

No system is completely secure. If a breach affects personal data, we will notify affected users or merchants, and the relevant authorities where required, without undue delay.

8. International data transfers

Data may be stored and processed in India, the United States and other countries where our providers operate. Where GDPR applies, we use appropriate safeguards such as Standard Contractual Clauses.

9. Children

Both services are only for people aged 18 and over. Photos of children must not be uploaded, and photos flagged as showing a minor are rejected and deleted. If you believe a child has given us personal data, contact contact@nfnlabs.in and we will delete it promptly.

10. Your rights

Depending on where you live, you can ask to access, correct, delete or export your data, restrict or object to its processing, and withdraw consent at any time. EEA and UK residents can also complain to their local supervisory authority.

• Extension users and merchants: email contact@nfnlabs.in. We reply within 30 days of a verified request, and provide exports in a common format such as JSON or CSV.
• Shoppers: contact the merchant whose store you used, or email us. We will act on your request, or pass it to that merchant. Because photos are deleted within 48 hours, we usually hold nothing after that time.

11. Changes to this policy

We will post updates on this page and change the date at the top. For material changes, we will also notify Extension users inside the Extension and merchants inside the Shopify App or by email.

1. Agreement and scope

These Terms of Use ("Terms") govern your use of Try It On, a product of NFN Labs (OPC) Pvt Ltd ("NFN Labs," "we," "us" or "our"). By installing or using either service below, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

These Terms cover two services:

• Try It On Chrome extension (the "Extension"), which you install and use yourself.
• Try It On for Shopify (the "Shopify App"), which merchants add to their Shopify store so their shoppers can use try-on.

How to read these Terms: Part A (Section 3) applies only to the Extension. Part B (Section 4) applies only to the Shopify App. All other sections apply to both. In these Terms, "you" means whoever is using the service: an Extension user, a merchant or a shopper.

2. Eligibility

• Extension users and shoppers must be at least 18 years old.
• Merchants must be at least 18, and able to enter a binding contract for the business whose store they install the Shopify App on. Accepting these Terms for a business confirms you are authorised to do so.

We rely on your declaration of age. We may suspend or end access if we have reason to believe a user is under 18.

3. Part A: Try It On Chrome extension

3.1 Account and security

• You sign up with Google Sign-In, and are responsible for keeping your Google account secure.
• You are responsible for all activity under your Try It On account.
• Tell us straight away at contact@nfnlabs.in if you suspect unauthorised access.

3.2 The service

The Extension lets you:

• upload reference photos of yourself;
• see clothing from supported online stores, such as Amazon, Myntra and Ajio, on your reference photos using AI; and
• save, compare, download and share your try-ons in your personal feed.

Consent to photo processing: uploading reference photos gives your explicit consent for us to process them only to generate your try-ons, as the Privacy Policy explains. This consent is separate from accepting these Terms, and you can withdraw it by deleting your photos or account.

Third-party stores: the Extension works on stores we do not own or control. We are not responsible for their products, prices, content or availability, and any purchase is between you and that store.

3.3 Use of generated images

You may use try-on images for personal, non-commercial purposes, including sharing them on social media. You may not sell them, use them in advertising, or present them as official images of a retailer's product.

3.4 Payments and refunds

• Payments: paid features are billed through our payment provider, [Stripe]. Prices and plan limits are shown before you buy.
• Refunds: payments are final and non-refundable, including for dissatisfaction with results or accidental purchases, except where the law requires otherwise. Your statutory rights, for example under India's Consumer Protection Act, 2019, or EU consumer law, are not affected.

4. Part B: Try It On for Shopify

Sections 4.1 to 4.6 apply to merchants. Section 4.7 applies to shoppers.

4.1 The service

The Shopify App adds a virtual try-on button to your store. Shoppers upload a photo of themselves and see the product they are viewing on them, generated by AI from your product images. You choose which products show try-on and how the button looks.

4.2 Plans and billing

• Billing through Shopify: all charges are billed through Shopify's billing system and appear on your Shopify invoice, in USD or in your local currency where Shopify supports it. We never receive your card or bank details.
• Plans: each plan includes a monthly try-on allowance, as shown on our App Store listing and in the app. Recurring charges are billed every 30 days. Custom or Enterprise plans may be agreed separately in writing.
• Plan changes: upgrades and downgrades take effect at the start of your next billing cycle, with no partial charges or credits. The exception is upgrading from the Free plan, which applies immediately.
• Cancelling: to stop paying, downgrade to the Free plan. This takes effect at your next billing cycle, like any other downgrade.
• Missed payments: if a charge fails, you have 3 days to resolve it. After that, your store moves to the Free plan.
• Price changes: we give at least 30 days' notice before changing the price of a plan you are on.

4.3 Try-on allowance and extra packs

• Monthly allowance: at the start of each billing cycle, your plan's allowance is added to your subscription balance.
• Rollover: unused subscription credits carry forward to the next billing cycle only, up to 25% of your plan's monthly allowance. Credits above that cap, or still unused after that one cycle, expire. The Free plan has no rollover.
• Extra try-on packs: on a paid plan, you can buy extra try-ons as separate one-off purchases, from 300 try-ons at $0.066 per try-on. They go into a separate top-up balance and do not expire.
• Order of use: try-ons use your subscription balance first, then your top-up balance.
• When credits run out: try-on pauses on your storefront until you buy an extra pack or your next billing cycle starts. We never charge you automatically for extra usage.
• Daily limit: to keep the service reliable for every store, each store has a daily try-on limit for its plan, shown in the app. Once it is reached, try-on pauses until the next day. Your unused credits are not affected.
• Plan changes: at a plan change, the subscription balance you carry forward is limited to the new plan's rollover cap (25% of its monthly allowance). Any excess moves into your top-up balance instead of being lost. Downgrading to the Free plan moves your whole remaining subscription balance into your top-up balance, which you can keep using.

4.4 Refunds

Plan fees and extra try-on packs are non-refundable, including when you downgrade, cancel or let rolled-over credits expire, except where the law requires otherwise or we agree in writing. Any refund or credit is issued through Shopify.

4.5 Your responsibilities as a merchant

• Tell your shoppers: your store's privacy policy must say you use Try It On for virtual try-on and link to our Privacy Policy.
• Product images: you must have the right to use the product images and information in your store for try-on.
• Children: do not invite shoppers to upload photos of children, for example on products marketed for children.
• Shoppers' images: do not use shoppers' photos or try-on images for marketing or any other purpose without their consent.
• Honest presentation: try-on images are AI previews, not photos of the real product being worn. Do not present them as exact representations of fit, size or colour.
• Lawful use: use the Shopify App only in line with Shopify's terms and applicable law.

4.6 Uninstalling

You can uninstall at any time from your Shopify admin. Shopify then ends your subscription, and no further charges are made. We keep your credit balances with our billing records, so if you reinstall, you pick up where you left off. Your store's other data, including shoppers' photos and try-on images, is deleted as the Privacy Policy describes.

4.7 Terms for shoppers

If you use try-on on a merchant's store:

• you must be 18 or older, and upload only a photo of yourself;
• uploading your photo gives your explicit consent for us to process it for try-on, as the Privacy Policy explains;
• you may use your try-on images for personal, non-commercial purposes, including sharing them; and
• try-on images are AI previews, and any purchase is between you and the merchant.

5. Acceptable use

5.1 Prohibited content

You must not upload content that:

• infringes others' rights: you must own, or have permission to use, every photo you upload;
• is illegal or explicit: no pornographic, sexual, violent or otherwise offensive images;
• shows another person without consent: upload only photos of yourself, never of third parties;
• impersonates anyone: or misrepresents your affiliation with a person or entity; or
• is harmful: such as malware or any other malicious content.

Content screening: all uploaded photos are screened automatically for prohibited content. Flagged content may be reviewed by a person, and we may remove it and suspend or end the account or access without notice. Flagged content is never used to train AI models. You can appeal a decision by emailing contact@nfnlabs.in.

5.2 Prohibited use

You must not:

• use either service for any unlawful purpose, or in breach of data protection or intellectual property law;
• reverse-engineer, decompile or try to extract our AI models, prompts or algorithms;
• interfere with the services, or bypass their security or usage limits;
• use bots, scripts or scrapers to access the services or extract data beyond their intended use; or
• resell or offer either service to others, or use it for any commercial purpose these Terms do not allow, without our written consent.

6. Protection of children

Both services are only for people aged 18 and over. We follow India's Digital Personal Data Protection Act, 2023, the Protection of Children from Sexual Offences (POCSO) Act, 2012, the Information Technology Act, 2000, and international child-protection practice.

• No images of children: uploading, processing or generating any image of a person under 18 is prohibited and a material breach of these Terms.
• Zero tolerance: creating child sexual abuse material (CSAM) or any other exploitation of minors is a serious criminal offence, punishable by imprisonment under Indian law and similar laws worldwide.
• Reporting: we monitor for this misuse and report suspected illegal activity involving minors to India's National Cyber Crime Reporting Portal and other law enforcement authorities. We cooperate fully, including by providing data and metadata.
• Parents and guardians: if you believe a child has given us personal data or photos, contact contact@nfnlabs.in and we will delete them.

You agree to indemnify NFN Labs against any claim arising from your upload or misuse of images of minors.

7. Intellectual property

• Our property: the software, designs, logos, AI models and other content of both services belong to NFN Labs or its licensors.
• Your photos: you keep ownership of the photos you upload. You give us a limited, non-exclusive, worldwide, royalty-free licence to store and process them only to provide the service to you.
• Product images: retailers and merchants keep ownership of their product images and designs. Merchants give us a limited licence to use their product images and information only to provide the Shopify App.
• Generated images: a try-on image combines your likeness with a retailer's or merchant's product. We give you a limited, non-exclusive, revocable licence to use it as Sections 3.3 and 4.7 allow. It does not give you rights to the product's design or brand.

8. Disclaimer of warranties

Both services are provided "as is" and "as available", without warranties of any kind. We do not promise that they will be uninterrupted or error-free. Try-on images are AI-generated previews: we do not guarantee that they accurately show how a product will fit, look, size or colour in real life. To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

9. Limitation of liability

To the fullest extent the law allows, NFN Labs is not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, sales, data or goodwill. This includes losses from product returns or purchase decisions based on try-on images. It applies to claims arising from:

• your use of, or inability to use, either service;
• the conduct or content of any third party, including stores, merchants and shoppers; and
• unauthorised access to or changes to your content.

Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

10. Indemnification

You agree to defend, indemnify and hold harmless NFN Labs and its officers, employees and agents against any claims, losses and costs, including legal fees, arising from:

• your use of either service;
• your breach of these Terms;
• your violation of anyone else's rights, including copyright, privacy and image rights; or
• for merchants, your store, your products, and your dealings with your shoppers.

11. Suspension and termination

• By us: we may suspend or end access to either service, without notice or liability, if you breach these Terms. For breaches that are not serious, we will normally give notice and a chance to fix them first, unless immediate action is needed to protect the service, other users or to meet the law.
• By you: Extension users can delete their account in the Extension or by emailing contact@nfnlabs.in. Merchants can uninstall the Shopify App from their Shopify admin.
• Effect: when access ends, your right to use the service ends immediately. Sections 5 to 13 continue to apply.

12. Governing law and disputes

These Terms are governed by the laws of India.

1. Any dispute will first be discussed in good faith.
2. If that fails, the parties will try mediation in Chennai, Tamil Nadu, India, before starting legal proceedings.
3. If mediation fails, the courts of Chennai, Tamil Nadu, India, have exclusive jurisdiction.

If you are a consumer, mandatory mediation may not apply to you, and consumer protection laws may let you bring proceedings in your country of residence.

13. General terms

• Changes to these Terms: we may update these Terms. For material changes, we give at least 30 days' notice in the service, by email or on this page. Continuing to use the service after changes take effect means you accept them.
• Severability: if a provision is found invalid, it is limited to the minimum extent needed, and the rest stays in force.
• No waiver: not enforcing a right does not waive it.
• Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and NFN Labs about the services. For merchants, Shopify's own terms also apply to your use of the Shopify App.
• Assignment: you may not transfer these Terms without our written consent. We may assign them, for example in a merger or acquisition.
• Force majeure: we are not liable for delays or failures caused by events outside our reasonable control, including natural disasters, war, outages of third-party services, and actions of authorities.
