This Privacy Policy explains what data we collect, how we use it, our legal bases for processing, and your rights regarding your information when you use the Try It On Chrome extension and related services (collectively, the "Service"). • Account Data: When you sign in using Google, we collect your email address, name, and profile picture as provided by Google. This is used for authentication and account management. Legal Basis: Performance of a contract (to provide you with the Service).
• Reference Photos (Biometric-Adjacent Data): To use the "Try On" feature, you must upload at least two reference photos of yourself. These photos, which capture your unique physical characteristics, are considered biometric-adjacent data under various data protection laws, including India's DPDP Act, GDPR, and CCPA. We collect and process these photos solely to generate the virtual fitting visualization and provide the core functionality of the Service. Legal Basis: Your explicit consent, which you provide when you upload these images. This consent is unbundled from the general acceptance of our Terms of Use and Privacy Policy, ensuring it is freely given, specific, informed, and unambiguous. You have the right to withdraw this consent at any time by deleting your photos or account, as detailed in Section 5.
• Support Communications: Any information you provide when contacting our support team at contact@nfnlabs.in. Legal Basis: Legitimate interests (to respond to your inquiries and improve customer service) or performance of a contract (if related to your Service use).

B. Automatically Collected Data

• Usage Analytics: We use third-party analytics tools (e.g., Google Analytics) to collect information about how you interact with the Service (e.g., features used, frequency of use). We do not send any personally identifiable information (PII) to these third-party analytics providers. All data shared with analytics providers is aggregated and anonymized. Legal Basis: Legitimate interests (to understand user behavior and improve the Service).
• Extension Activity: Information about the e-commerce stores where you use the extension (e.g., Amazon, Myntra, Ajio, Shopify) to enable the "Try On" functionality. This data is processed locally within your browser or in an anonymized form to identify product images for the virtual try-on feature. Legal Basis: Performance of a contract (to provide the core functionality of the Service).
• Technical Data: Browser type, version, operating system, and device information to ensure compatibility, performance, and security of the Service. Legal Basis: Legitimate interests (to ensure the security and functionality of the Service) and performance of a contract.

3. How We Use Your Information

• To Provide the Service: Generating virtual try-on visualizations based on your reference photos and selected clothing items, including AI processing to create composite images.
• To Maintain Your Feed: Saving your try-on history so you can view, favorite, and compare items later, providing a consistent and personalized experience.
• To Improve the Service: Analyzing anonymized and aggregated usage trends to enhance features, optimize performance, and develop new functionalities.
• Communication: Sending important service updates, security alerts, or responding to inquiries.
• Legal Compliance: To comply with legal obligations, resolve disputes, and enforce our agreements.

4. AI and Data Usage Commitments

• No Training on User Data: We do not use your reference photos or generated try-on images to train our AI models or any third-party models. Your personal data is not used to improve AI models for other customers or third parties.
• No Data Sales: We do not sell your personal data, photos, or usage information to any third parties.
• Third-Party AI Processing & Data Processing Agreements (DPAs): We may use third-party AI infrastructure providers to process images. These providers are contractually bound to process data only according to our instructions and are prohibited from using your data for their own purposes. We ensure that these providers adhere to strict data protection and security standards, and we have Data Processing Agreements (DPAs) in place with all such third-party processors to ensure your data is handled in compliance with applicable data protection laws.
• Ownership of AI-Generated Output: While the AI model generates the composite image, the underlying elements (your likeness, retailer's product design) retain their original ownership. We grant you a license to use the AI-generated output for personal, non-commercial purposes as outlined in our Terms of Use.
• Automated Content Moderation (NSFW Screening): To maintain a safe and appropriate environment, all uploaded reference photos are subject to automated Non-Safe for Work (NSFW) screening. This process helps us detect and prevent the upload of illegal, explicit, or otherwise prohibited content. This screening is performed by automated systems and is not used to train AI models or for any other purpose beyond content moderation. In cases where content is flagged, further review may be conducted as outlined in our Terms of Use.

5. Data Retention and Deletion

• Retention: Your reference photos and try-on results are retained securely on our hosting servers for the duration of your active account to provide you with a consistent experience and access to your "feed." This data is stored in secure hosting environments with restricted access. If you delete your account, your data will be permanently deleted from our active servers within 30 days, and from our backup systems within 90 days, unless a longer retention period is required by law or for legitimate business purposes (e.g., fraud prevention, legal claims).
• User-Requested Deletion: You have the right to request the removal of your data at any time. You can delete your reference photos or your account directly within the "Try It On" Chrome extension. Alternatively, to request deletion of your data, please contact us at contact@nfnlabs.in. We will process your request in a timely manner, typically within 30 days, unless otherwise required by law.

We adhere to the principle of data minimization, collecting only the data necessary to provide the Service. While we strive to protect your personal data, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security. You are also responsible for maintaining the confidentiality of your account credentials.

• Google Sign-In: Your use of Google Sign-In is subject to Google's Privacy Policy.
• E-commerce Platforms: The extension operates on third-party websites (e.g., Amazon, Myntra, Ajio, Shopify). We are not responsible for their privacy practices. We do not scrape or store product images; the extension processes images dynamically within your browser.
• Payment Processing: Payments are processed securely through third-party providers (e.g., Stripe). We do not store your full payment card details.

We use cookies and similar tracking technologies (e.g., local storage) to enhance your experience, analyze Service usage, and for security purposes. These technologies help us understand how you interact with our Service, which features are most popular, and to identify and fix errors.

• Analytics Cookies: We use Google Analytics to collect anonymized and aggregated data about Service usage. This helps us improve the Service. These Terms of Use ("Terms") govern your access to and use of Try It On, a product of NFN Labs ("NFN Labs," "we," "us," or "our"). By installing the Try It On Chrome extension or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By using Try It On, you represent and warrant that you have the legal capacity to enter into these Terms. While we rely on your self-declaration of age during Google Sign-In, we reserve the right to terminate accounts if we have reason to believe a user is under 18.

3. Account Registration & Security

• Google Sign-In: You must register for Try It On using Google Sign-In. You are responsible for maintaining the security of your Google account and for all activities that occur under your Try It On account.
• Account Security: You must immediately notify us at contact@nfnlabs.in if you suspect any unauthorized access or security breach of your account.

4. Service Description & Use Restrictions

Try It On provides a virtual fitting room experience through a Chrome extension. The Service allows you to:

• Upload reference photos of yourself, which are considered biometric-adjacent data. By uploading these photos, you explicitly consent to their processing by our AI models solely for the purpose of generating virtual try-on visualizations, as further detailed in our Privacy Policy. This consent is separate from your acceptance of these Terms and can be withdrawn as described in the Privacy Policy.
• Visualize clothing items from supported e-commerce platforms (e.g., Amazon, Myntra, Ajio, Shopify) on your reference photos using AI.
• Save and compare try-on results in your personal feed.

A. Prohibited Content

When using the Service, you agree not to upload, post, or share any content that:

• Infringes Copyrights: You must have the legal right to use any photos you upload. We reserve the right to remove any copyrighted images that you do not own or have permission to use. This includes product images from third-party e-commerce sites; you are responsible for ensuring you have the right to use such images for personal try-on purposes.
• Illegal or Explicit Material & Content Moderation: You are strictly prohibited from uploading illegal, explicit, pornographic, or otherwise offensive images. To ensure a safe and compliant environment, all uploaded reference photos are subject to automated Non-Safe for Work (NSFW) screening. This automated process helps us detect and prevent the upload of prohibited content. If content is flagged by our automated systems, it will be subject to further review, and we reserve the right to remove such content and terminate your account without notice. We do not use content flagged by NSFW screening to train our AI models. Users whose content or accounts are terminated due to violations may appeal by contacting contact@nfnlabs.in.
• Harmful Content: You may not upload content that contains malware, viruses, or any other harmful code. While direct injection through image uploads is unlikely, this prohibition covers any form of malicious content or activity.
• Impersonation: You may not impersonate another person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Third-Party Likeness: You may not upload photos of third parties or generate images using their likeness without their explicit consent.

B. Prohibited Use

You agree not to:

• Use the Service for any unlawful purpose or in any manner that violates any applicable local, national, or international law or regulation, including data protection and intellectual property laws.
• Reverse-engineer, decompile, or attempt to extract the underlying AI models or algorithms of the Service.
• Interfere with the operation of the Service or attempt to bypass any security measures.
• Use automated bots, scripts, scrapers, or other automated means to access the Service or extract data, including product images from third-party websites, beyond the intended functionality of the Chrome extension for personal try-on purposes.
• Use the Service for any unauthorized commercial purpose without our express written consent.

C. Protection of Children & Legal Implications

Try It On is committed to the highest standards of safety and legal compliance regarding the protection of minors. In accordance with the Digital Personal Data Protection Act (DPDP Act), 2023 (India), and the Protection of Children from Sexual Offences (POCSO) Act, 2012 (India), as well as international best practices for child protection, the following terms apply:

• Age Restriction & Consent: The Service is strictly intended for users aged 18 and above. We do not knowingly process the personal data or photos of children (individuals under the age of 18). If you are a parent or guardian and believe your child has provided us with personal data, please contact us immediately at contact@nfnlabs.in for deletion.
• Prohibition of Child-Related Content: Users are strictly prohibited from uploading, processing, or generating any images featuring children. Any attempt to use the Service to manipulate, store, or distribute images of minors is a material breach of these Terms.
• Zero Tolerance for Misuse: The misuse of children's photos, including but not limited to the creation of Child Sexual Abuse Material (CSAM) or any form of digital exploitation, is strictly prohibited.

Legal Implications & Reporting:

• Criminal Liability: Under the POCSO Act and the Information Technology Act, 2000 (India), the possession, storage, or distribution of exploitative material involving minors is a non-bailable criminal offence punishable by imprisonment and fines. Similar laws exist in other jurisdictions globally.
• Mandatory Reporting: NFN Labs maintains a zero-tolerance policy. We reserve the right to monitor for such violations and are legally obligated to report any suspected illegal activity involving minors to the National Cyber Crime Reporting Portal (India) and relevant law enforcement authorities in India and internationally.
• Data Cooperation: We will fully cooperate with law enforcement agencies, providing necessary data and metadata to assist in the prosecution of individuals misusing the Service in relation to minors.
• Indemnification: You agree to indemnify and hold NFN Labs harmless from any legal actions, damages, or liabilities arising from your unauthorized upload or misuse of photos involving minors.

5. Ownership of AI-Generated Output

The AI-generated composite images created by the Service combine elements of your uploaded reference photos and product images from third-party retailers. While you retain ownership of your original reference photos and retailers retain ownership of their product images and designs, NFN Labs grants you a limited, non-exclusive, revocable license to use the AI-generated composite images for your personal, non-commercial use within the Service and for sharing on social media, provided such sharing adheres to these Terms and does not infringe on third-party rights. You acknowledge that the AI model itself is proprietary to NFN Labs or its licensors.

6. Payments & Refund Policy

• Payments: Certain features of Try It On may require payment. All payments are processed through third-party payment providers (e.g., Stripe).
• Refund Policy: All payments made for Try It On services are final and non-refundable, except as required by applicable law. This means that while we generally do not offer refunds, your statutory rights under applicable consumer protection laws (e.g., India's Consumer Protection Act, 2019, or EU consumer laws) remain unaffected. By making a purchase, you acknowledge and agree that, subject to mandatory consumer protection laws, no refunds will be issued for any reason, including but not limited to dissatisfaction with the results or accidental purchases.

7. Intellectual Property

• Our Content: All software, designs, logos, AI models, and other proprietary content used in the Service are the property of NFN Labs or its licensors and are protected by intellectual property laws.
• Your Content: You retain ownership of the photos you upload. However, by uploading photos, you grant NFN Labs a limited, non-exclusive, worldwide, royalty-free license to use, process, and store your photos solely for the purpose of providing the Service to you (i.e., to generate try-on images and maintain your feed).

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. NFN Labs does not warrant that the Service will be uninterrupted, error-free, or that the AI-generated visualizations will be accurate, reliable, or true-to-life. The accuracy of any AI-generated visualization or representation of how a clothing item will look in real life is not guaranteed. NFN Labs disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, NFN Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; and (d) unauthorized access, use, or alteration of your transmissions or content; whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

You agree to defend, indemnify, and hold harmless NFN Labs, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your content caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the Service.

11. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation a breach of the Terms. For non-material breaches, we will generally provide notice and an opportunity to cure, unless immediate termination is necessary to protect the security or integrity of the Service or to comply with legal obligations. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by deleting your account within the extension or contacting us at contact@nfnlabs.in.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or the use of the Service, shall first be attempted to be resolved through good faith negotiation. If a dispute cannot be resolved through negotiation, you agree to first engage in mandatory mediation in Chennai, Tamil Nadu, India, before initiating any litigation. While we aim for resolution through mediation, you acknowledge that mandatory mediation may not be enforceable against consumers in certain jurisdictions (e.g., EU/UK/US). If mediation is unsuccessful, any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Chennai, Tamil Nadu, India, and you consent to the jurisdiction of such courts, subject to applicable consumer protection laws that may grant you the right to pursue legal action in your country of residence.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

14. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

15. Force Majeure

NFN Labs shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure is caused by events beyond its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labor or materials.

16. No Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and NFN Labs' failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

17. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notice published by NFN Labs on the Service, shall constitute the entire agreement between you and NFN Labs concerning the Service.

18. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null and of no effect. NFN Labs may freely assign or transfer these Terms without restriction.
